Tom Cruise's lawyer is threatening to sue the National Enquirer over a cover story that claims the actor is a "monster" who "abused" wife Katie Holmes and subjected daughter Suri to a five-month stay in a "tiny, windowless room."

In a blistering letter sent July 11 by longtime Cruise attorney Bert Fields to Enquirer publisher American Media, a copy of which was obtained by The Hollywood Reporter, Fields claims the tabloid's most recent cover story is "disgraceful and lurid" and will cause the actor "hundreds of millions of dollars of professional and personal damages, for which we intend to hold American Media, and everyone who participated in the perpetuation of this scurrilous attack, jointly and severally liable."

That kid gets photographed all the time. A break of 5 months would be noticed. When she was born there was a lot of muttering about no pictures/sightings of her for some weeks, if I remember rightly, until pictures were released. She is a celeb in her own right.


Embellished or twisted truth is one thing, and par for the course in gossip rags, but this is just too much.

He should sue.

While Cruise may be outraged by what the magazine printed, a lawsuit would be directly counter to the privacy he sought in his divorce. The publication would have virtual free rein to discover evidence to support its article, which could become public at trial.

Under U.S. libel law, Cruise would have to prove that the publication knew the allegations were false and reckless but printed them anyway as an act of malice.

Fields asked the publication to retract the allegations, and threated to “call the Court’s attention to your long record of printing and publishing malicious lies about celebrities in order to enrich yourselves at their expense.”

But Cruise has also been known for some bizarre behavior, and all of that would be fair game in a trial.



It may be worth it to the publication to get sued because what would come up in the trial would be more fodder for the press. The Enquirer would come out winning no matter what the outcome was.

Boy, Cruise is certainly having a bad couple of weeks.

TC has an uphill battle, and if he wants all his dirty laundry to be aired, this is the way to do it.
