AN Uzbek asylum-seeker who claims he endured two days' torture by police for being a Scientologist has won protection in Australia by arguing the documents he used to reach Australian shores were actually falsified.

The man, a middle-class factory director in Uzbekistan, said he converted to Scientology from Islam in 2006.

He said that by mid-2010 he had networked with a handful of other secret Scientologists and was translating the faith's religious texts from Russian for distribution to people in his town.

He was then summoned to his local police headquarters, where he was tortured over his alleged role in spying against the regime of dictator Islam Karimov, with interrogators breaking his nose and "squishing" his fingers until he gave up the names of his fellow Scientologists.

Many refugees come to Australia using falsified documents. A refugee is:

"Any person who owing to a well founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion, is outside the country of his/her nationality and is unable, or owing to such fear, is unwilling to avail himself/herself of the protection of that country."

It is quite plausible that a Scientologist could be a target for persecution in a primarily Muslim country and be unwilling to return to that situation. The Refugee Review Tribunal certainly found that to be the case.
