COS sued for fraud

Misunderstood Genius

That out of the way, it's possible that you may be thinking of this.

From a 2007 ESMB post by Alan Walter, a student on the Class Eight course on the ship:

The scene with overboarding on the Original Class VIII Course was if an auditor did not get an F/N on their pc at examiner - they were thrown overboard.

We would line up on the well-deck in the morning at 8.00 am - LRH would look down from the deck above and announce who would be thrown overboard.

He was surrounded by his Aides. Also he was recording all of this on camera....

I remember looking up at them - I was staring into the face of shear madness and evil.

Usually 8 to 10 people were thrown overboard each morning.

It was about a 30 foot drop into a filthy feces laden water from the other ships and the Apollo directly releasing their sewage into the channel...

This was October 1968.

....Ron had Julia Salmon thrown overboard... terribly overweight and could not swim.

The people who threw her overboard struggled to get her over the side; she was terrified; she kept crying out "I cannot swim!" On her way down she hit the side of the ship - I could hear her screams - it was obvious she was injured and drowning.

The people on the deck all stood around too afraid to do anything. Fearing to originate any action less the become the target of LRHs displeasure.

I ran and jumped over the side and rescued her. I then pulled her over to the ladder that led up to the ground level of the dock........it was about 20 feet straight up. She could not climb the steps. I had my shoulders under her butt pushing her up..... no one still had come to help.......but at the top of that ladder stood LRH filming us.....such evil.......

Anyway after an immense struggle with Julia's help I was able to push her up to the top of the ladder....finally some help arrived.

Over the years the unthinkable thought pushed forward more and more....it was 'that I observe that LRH was demonic at that time'. I did not want to know that, did not want to believe that.......that was too incredible to be believed - even for me - I did the usual make nothing of myself....'you're seeing things', 'what do you know', 'you've got overts' - much easier to blame self than confront what is
.

this is very good writing...

What you wrote doesn't even come close to my memories. Basically I remember lots of sex with pretty women. lots of parties. lots of rock n roll. and lots of work to buy a house, going out to dinner, movies, the Fillmore, Fillmore West, hot tubs, horses...

This was a Dianetics Book One result. John Brodie was going to retire because of a bad shoulder. Phil Spickler fixed it with Dianetics. You can read about it in Larry Wright's book. instead of retiring, John was voted MVP (Most Valuable Player). it lead to most of the 9ers and their ownership getting auditing.

My girl friends, my friends, people on staff NEVER EVER talked about such malarky. EVER!

There were loads of people who wore glasses and contacts.

Our tennis games was much more important than exterior with full perception.

As a side note: Phil Spickler, now in his 80s, plays full blast tennis weekly with 40 year olds including one grand son. Phil embodied the Scientology persona in the Bay Area of the 70s.

It was about living life to the fullest.

I went Clear (through OT 3) and did the briefing course for under $5,000.

When my wife and I left the Co$ in 1976, nobody got their feathers ruffled except her (then soon to be) ex husband, who ran the Palo Alto center.

One of my PCs from that period, was a 12 year old girl then, when she started. She now has kids out of college, and is our mortgage broker these days. Enduring friendships were made that lasted well past all of our disaffections from scientology. Her dad wrote a recommendation letter for my daughter to get into his old school.

I remember chatting with Rick Melrose and Drew Johnston, both class Vlll friends of mine, and Margaret Singer (or Sanger- spelling?) at Foothill College before or after a televised talk about whether Scientology was a cult. She said it was. I think she was from Berkeley and something like the Cult Awareness Network (not sure of these names exactly). I told the three of them, that I had left years ago (probably 6 or more), and Drew and Rick were still friends and social connections. No snakes in the mailbox - which some cult in Marin had (then) recently done.

"9ers"?!?

it's 49ers if you're using numbers otherwise it's 'niners

step lively now, we got a big game comin' up

and in *other* "news"... http://omg.yahoo.com/blogs/celeb-ne...18th-birthday-london-nightclub-181138299.html

Wow - who'd want to read a boring article about legal-blah-blah-fraud-blah-blah when a film star's son celebrates a birthday, and his sister DYED HER HAIR?!?!

When the going gets rough, the tough...trot out their tots? Oh. :duh:

JB. :eyeroll:

If it isn't a fake VM photo op it's often kids and other "theta" derails in an attempt to trump a story like the cult being brought down. Good eye! :)

I heard it on the t.v. news last night, about the lawsuit....:happydance: I seriously danced a little jig with happiness!!!

It was mostly presented as "the Church of Scientology has lost it's way and become a secular organization focused on moneymaking"... "former members want their money, which was donated to do charitable and humantitarian works, but was used for other purposes, back!!"

This was a major LA station...HURRAH!!!

I don't doubt that Miscavige is on the top, pushing people to do anything to get more money out of the whales, but I imagine some of the finer details, like getting Luis to buy the "emergency" cross for the SP building, would be one of the "acceptable truths" told just to make quota, for some overenthusiastic bad applereg. After all, how much would Luis have given if he were told he would be buying 40 toilets for the SP building, which would have been a better metaphor for where your money goes anyway? I don't think Miscavige thought up that ruse himself, about the cross.

As long as there are enough people who feel their "eternity" is connected to sucking money out of their fellow members, "before it is too late," then that's pretty much the main culture of Scientology -- a culture with some violence at the top, but a culture of money sucking at the top, middle and bottom.

The false charitable fronts -- fighting Internet child porn, paying people to give testimony they were helped by Scientology VMs, charitable activities by the VMs that are heavy on PR production but short on helping -- that's where it could get interesting. Those things would be terrible PR for the cult when they come out in court, if they get some insider who was directly involved with one of those scams to spill the beans.

I found these comments on Marty's blog to be of interest. YMMV.

First, an observation I largely (but not entirely) agree with.

While the complaints of violence towards Sea Org members at the hands of Miscavige may not have had an impact on many public scientologists, this lawsuit will. Every public member can relate to being bombarded with aggressive ‘requests’ for donations for this cause or that activity (ie, the superpower building, distributing the ‘Way to Happiness” booklets). Because they can relate to it, they will most likely realize they are not alone in feeling like they were duped by their own church which is something many of them have probably never talk about openly. They were simply to afraid to talk about it due to the fear that they would be reported. This lawsuit validates the feeling that they were being lied to about where the money was going. Win or lose, this will no doubt have an impact on those who are considering joining the corporate church as well as those who are already in it.
Combine this lawsuit & Debbie’s Cooks letter and you realize the month of January hasn’t been Miscavige favorite time of year. This is going to help public scientologist make the decision to go independent. I predict, that for many this will be the proverbial straw that will break the camels back.
Next, the desperate desire and effort to differentiate the "religion" and "applied religious philosophy" of Scientology from the corporate "Church of Scientology."

Every time I see the word “Scientology” in articles like this, I am filled with outrage at what DM has allowed our religion to become.

Scientology, The Subject .. is distinct from “Scientology, the Church”, yet the conflation is made.

I’m hoping this court case is the first crack that makes the divide between the behaviour of the Church of Scientology, and that of Scientologists, very clear.

If there were ever a time for the Independent scene to get its PR guns out and start promoting far and wide the creation of Clears, OTs, and Auditors, that time would be now.

We must – WE MUST – work diligently as Scientologists to ensure that Scientology, The Subject, becomes a far better understood topic, and that the Church of Scientology, and its criminal leadership, ends up in jail for their crimes.

I say that disassociation is the new order. We, Scientologists, applying Scientology, *must* stick to our guns and ensure that the religion itself, followed correctly, would have *never* produced such a vile element as DM and his Minions, if it were actually being *applied*.

And Reuters....

http://www.reuters.com/article/2013/01/24/us-usa-florida-scientology-idUSBRE90N1A520130124

This will make life interesting - every little shitsville news outlet reads stuff off of Reuters during their national news. Scientology will not be able to sue them all! Especially because they're dealing with their own suit....

:hysterical:
Excerpt:
The couple allege they donated more than $420,000 to a building project and other church initiatives including counseling services but that the church "improperly utilized" the money.

The construction project was to build the church's "Super Power" building in Clearwater, Florida, using more than $200 million in total donations raised by the church, the lawsuit contends. But the lawsuit claims that less than half the money was spent on construction and that the building stands empty more than 14 years after the groundbreaking ceremony.

According to the lawsuit, the Garcias learned the money they donated was used to "stifle inquiries into the church's activities and finances" and bankroll "the lavish lifestyle" of its leader, David Miscavige.

No ... L Con Hubbard is not appalled - he is crispy fried burning in hell and not a happy theetan...he is getting tortured by Satan - and Hubbard wants David Miss Cabbage to join him! Don't ever think for one minute Blubbtoad cared about people...just look at the results!

I do think that there is poetic justice in this lawsuit and what is happening to the church in general. D.M is product/result of Scientology - pretty much raised on it in his teen-age years and all of his adult life- he's known little else. I heard Laurence Wright speak and he said that at least L. Ron had some kind of life experience before going into Scientology - but DM is Scientology. In other words, L. Ron's monster baby, the true fulfillment of his technology, is actually an insane ron-bot who is going to single-handedly bring the church to its knees and destroy Ron's legacy. All because Ron was greedy and incapable of nuance. I hope DM does end up on the witness stand. His downfall will be operatic and he'll definitely take others with him.

The law has the "tech" to prove misappropriation of funds! This is how it works:

"Show us your books"! "We would like to see how you have spent the parishioner's money."

"David Miscavige - do you have a personal chef that prepares 5 meals daily, 2 choices of entrees for each meal? Can you give us a list of the vehicles you drive, make and model? Can you describe your home at the Int Base? Do you have final authority over how money is spent in Scientology? Did you order Sea Org members to get donations in the "ethics department" at the Fraud Scam Base? Did you spend $20 million dollars on hiring private investigator's to follow Pat Broeker? Did you ever sue someone who spoke out against your "church" and harass them to shut them up?"

It is called "DISCOVERY" and there is a very specific TECH applied that L Con Hubbard never suspected would come back at him and his CULT!

I know.
I just suspected that they have "cooked the books" and that would make it very difficult.

I do hope that Garcia wins.

^^^^My bold above.

I especially agree with your assessment bolded above, but, given his particular brand of aggression coupled with his innate cowardice, I expect those others will be pushed/kicked out first. If he views the opposing attorneys as a pack of famished wolves, better to throw bodies out the door, let the wolves feed and be 'full' when/if he has to come out of his bunker.

Me? I hope the wolves stay hungry.

And I'm thinking that this is one of the reasons to depose him first. He is such a coward that he would study the transcripts from the other depositions. He is known to micro manage litigation, so I'm sure he would find a way to read the transcripts. That could lead him to either lie to stay consistent with the other deponents' statements, or possibly use the deny deny deny tech to throw them under the bus. This way, he is more likely to say something damning, or possibly even perjure himself in a very easy to prove way. That's really the only strategic advantage I see, but it is entirely possible that I'm missing something really big.

The only other explanation would be to get him to fold, do the Bulgravian Boogey, or end cycle in his bunker Fuhrer-style. But I don't think these plaintiffs want that - I think they want him by the short and curlies for as long as possible and savor the moment.

Great point. Actually, as much as I'd like to see him go down - the church may actually settle before the discovery stage with one of those statements like, "While the church does not admit that it is culpable in any way or in agreement with Mr. Garcia's statements, and while COS in not in the practice of settling lawsuits as a general course of action, we feel in the best interest of our other parishioners and our ongoing priority of "clearing the planet" that the decision to settle these suits is right course of action at this time...Our biggest concern, and only real concern has been about Mr. Garcia's eternity and not his money..."

Or something stupid like that....

Getting out of a lawsuit involving money is probably pretty easy for them, as they have a billion dollars or something in off-shore accounts. Wright says that even the Catholic church can't get their hands on the kind of money in liquid assets that COS has. So I don't think they give a shit about a few thousand here and there. I think the real impact is on the bad press that is relentless coming from all sides. It just doesn't look good in the press and I'm sure that worries them to no end.

I actually believe that what they won't be able to avoid/escape from are criminal charges. I have a feeling something is going to come to light soon, there may be a death in the RPF, or something of that nature, or something from the past with no statute of limitations is going to be re-investigated. He will be subpoenaed in a criminal trial.

P.S. Perhaps this needs its own thread, or has been discussed before, but this is the first time it's occurred to me: I really feel that LRH might have been murdered. I think he became more out of the control, more mentally ill, required more medication and was generally out of his mind and a liability to the church's brand. They probably felt they were "releasing" him from his body, but I think he might have died with some help.
