It’s the kind of nightmare courtroom scenario that keeps all but a few lawyers from going near litigation with the Church of Scientology.

On August 26, a woman who for two years has been suing numerous Scientology-connected people and entities was ordered by a federal district court to turn over the entire contents of her personal laptop hard drive to the people she was suing.

Everything on her hard drive. Her personal emails with her own attorneys. Emails to her family members. Her personal photographs. Her personal medical records. Even photographs of her breasts that she had taken to document her fight against breast cancer.

Gigabytes of intensely personal information and photos and passcodes, all handed over by a federal magistrate judge to the attorneys representing Scientology’s entities.

And only after that ruling was made did the woman’s attorneys learn a barely believable additional detail. The judge who made that ruling? Before he became a judge in 2003, he had worked for the very law firm he turned the woman’s laptop over to, a law firm where his wife still works to this day.

Even beyond the personal data being turned over to the opposition, there was attorney /client communication handed over. Isn't that a violation of basic rules of jurisprudence, and grounds to have any judgment going against her (I know she is doing the suing) or weakening of her case, appealed and thrown out?

I would wager that OSA maintains an extensive database of Federal, State, and Municipal Judges and was aware of the enormous conflict of interest which any ethical jurist would disclose without hesitation. The Scientology lawyers must have turned cartwheels upon learning this news.

All of which again underscores the importance of having great lawyers like Ray Jeffrey, who have both the legal knowledge and intestinal fortitude to take on this vile organization, and win.

Hi Len - I don't think he can practice in that state. A common mistake people who sue Scientology make is thinking they play by the rules. They should take the time to study and read up on their tactics. Take the Lisa M. case - they coerced the county medical examiner, had smooze fests with some Scientology celebs, destroyed evidence, sent the staff involved to far off places.

If only this woman realized she was dealing with an organization that A) believes itself to be above the (wog) law, B) is run by a full blown sociopath, C) uses the court and laws to wear down opponents per policy, D) will use any means legal or not to win, delay, lengthen, or get thrown out a suit, E) will break in and steal evidence against them, etc etc, she might have fared better. Now we get to add hack computers to the list as well.

Poisonous snakes make better bed fellows.

Request to disqualify judge in NAFC case is denied

Last week we told you about the disturbing recent developments in the National Association of Forensic Counselors’ trademark lawsuit against Scientology’s drug rehab network, Narconon. NAFC’s CEO, Karla Taylor, was ordered to turn over the entire contents of her personal hard drive to Narconon’s attorneys by Magistrate Judge Steven Shreder, even though the drive contained intensely personal information about Taylor that has nothing to do with the lawsuit.

And then Taylor’s attorneys learned that Shreder not only used to work for one of the law firms representing some of the lawsuit’s defendants, but that his wife, Sandy Shreder, currently works at that law firm as a legal assistant.

But District Judge Ronald White dismissed the motion filed by Taylor asking that Shreder be disqualified because of his connection to his former law firm, saying that he wasn’t troubled by those connections.

“At a rough estimate, probably 25 to 30 percent of that magistrate’s household income comes from the law firm representing the defendant in a case he’s making critical rulings on. I just don’t see how that’s anything other than an appearance of impropriety,” said Texas Lawyer, one of our legal experts.

But that appearance of impropriety was apparently not enough to convince Judge White that Shreder shouldn’t be making decisions about who gets to see Karla Taylor’s most intimate information.
