That this cult of criminal activity claims any sort of integrity or honour is indeed laughable, as are claims that parisioners are hurt by the truth (like anyone in the cult would be reading anything 'entheta' , that covers anything not written by LRon Flubbernutz, sheesh).
Cult's bottom line is cash, almost everyone knows this, and that is what strikes the greatest fear in the management, loss of revenue, and this I think bears repeating over and over using many examples.
Done right I see this as another excellent opportunity to unlock some more CoS closets and let the skeletons dance, and given the amount of publicity that is already shining in their eyes, the world-wide interest, another venue for inoculation for people everywhere.
Y'all know what ta do and don't worry too much about redundant materials being sent for defence as I'm sure they'll sort that part out. I sort of agree with suggestions that giving too much strategy away at this time isn't good as it gives cult more time to selectively counter, probably best to surprise the bastads in the court itself and let them scramble from there ;)

I have sent Maria an email, I hope to be able to do something. They have no humanity in the cult, these are mad, crazy, frighting people. Some get out and get better, others don't. I am horrified, but not surpised, that they have taken this action. That it is taken against a pensioner off of whose savings whole divisions of the cult spent a good 10 years or more living off of, they ruined her finacially and to top it they took her only child. Monsters. But she a strong woman, I met her in Pisa a year ago, we had a coffee, and I was deeply impressed by her. She is not well, but remarkably robust despite the harassment - which included burning her car out - I admire and indeed love this powerful lady.

I agree with you. Coming from a distant European background elderly people are respected. Unless things have changed the elderly will have the sympathetic ear of the courts. Scientology will loose in court and in the public eye also. Maybe Miscavage has no respect for the elderly but the general european population does. I can bet on it.

Mrs. Di Gasparro Gardini has demonstrated and expressed on many occasions absolutely unjustified acrimony and anger toward the Church of Scientology and the intention of acting to damage the Church of Scientology in order to defame it, to discriminate against it or, to use Mrs. Di Gasparro Gardini's more succinct terminology, "to kick Scientology's ass" [translator's note: "inchiappettare Scientology", literal translation: "to bugger Scientology"].

7. The harm caused by these behaviors and insults was suffered by the Church as an institution representing the Scientology community in Italy as well as by individual parishioners, who are inevitably affected by the negative impact of the defendant's claims.

8. In particular, Mrs. Di Gasparro Gardini, in the books of which she is co-author together with journalist Alberto Laggio for Edizioni Paoline, in newspaper interviews, on television, and also in newsgroup postings, has repeatedly lashed out at the Church of Scientology, using terms that are patently aggressive and offensive, because they denigrate the integrity and honor of the injured party.

9. This refers in particular to expressions such as "Stupidology" [translator's note: the Italian word is "Sciemology", from scemo "stupid"], used instead of Scientology (EXSCN newsgroup, August 21, 2009: "Stupidology" ["Sciemology"]; EXSCN newsgroup, September 16, 2009 "the children of Stupidology" ["i ragazzi di Sciemology"]), referring to both the Church itself and to its parishioners; or "they are like snakes, they crawl everywhere" (EXSCN newsgroup, July 6, 2009) insulting and denigrating the parishioners who contribute to social improvement campaigns promoted by the Church of Scientology (against drugs, against illiteracy, in defense of human rights, etc.): "donations made by the fools" ["donazioni fatte dai gonzi"] (EXSCN newsgroup, February 11, 2009).

Not limiting herself to this, Mrs. Di Gasparro Gardini has repeatedly, without producing any evidence of what she claims, accused the Church of Scientology of undertaking acts of intimidation at the fringes of the law, attributing to Scientology parishioners extremely serious misconduct which is absolutely not tolerated within the Scientology community itself.

Therefore, in response to the above statements and claims of Mrs. Di Gasparro Gardini, the National Church of Scientology of Italy today considers itself obligated to proceed to protect its reputation and its honor, dignity, and integrity, as the institution representing Scientology in Italy and representing Italian parishioners and ministers, upon whom, as mentioned earlier, the defamatory and discriminatory effect of Mrs. Di Gasparro Gardini's conduct falls heavily.

14. It should be noted at this point that defamation is manifested and constituted whenever the reputation of a person is injured by expressions, news, OPINIONS, COMMENTS, which go beyond the limits of the free expression of thought. The protected legal interest is therefore defined "by a man's reputation, by the esteem which radiates throughout the social environment, by the opinion that others have about his honor and dignity" (Court of Cassation 28.2.1995) and is obviously damaged by statements such as those which have been quoted.

In a similar case, in which the offended party was the congregation of Jehovah's Witnesses, the court accepted the observations of the prosecution, who pointed out that the defendant had used terminology laden with aggressiveness and even more "direct and explicit, crude and coarse" expressions (such as those adduced above and used by Mrs. Di Gasparro Gardini, for example "Stupidology" ["Sciemology"], "vultures", "fools" ["gonzi"], "to kick Scientology's ass" ["inchiappettare Scientology"]) and the court upheld the complaints of the injured parties because of the "expressions and phrases which are surely apt to offend the reputation of the followers of the religious denomination of Jehovah's Witnesses and which evidence a willingness to single out the followers for public scorn; there exists no cause for exemption from penalty, as the expressions used do not constitute the legitimate exercise of freedom of the press and of criticism. "

From the foregoing, it is quite evident that the National Church of Scientology of Italy has suffered and continues to suffer very heavy damages directly caused by the defamation perpetrated via the activity and statements of Mrs. Maria Pia Di Gasparro Gardini.

The verbal violence, the unjustified insults, the demonstrated acrimony and the false allegations by Mrs. Di Gasparro Gardini today lead the National Church of Scientology of Italy to protect the honor, dignity, and integrity of the Church and of the parishioners of the Scientology religion in this Church.

Regarding this point, it is necessary to emphasize that, given the manner in which the affront against Scientology was and still is being committed, the damage is far from being limited in time and is, on the contrary, extremely present, and therefore requires pre-trial intervention to protect the rights of the Church of Scientology and its parishioners even during the waiting period before this procedure.

For all the foregoing reasons and considerations, the National Church of Scientology of Italy, identified, represented, and located as stated at the beginning

Mrs. Maria Pia Di Gasparro Gardini, born in Rovereto on October 14, 1936, residing in Grosseto at Via Bonghi n. 1, to appear before the Grosseto Civil Court at its known address, chamber and judge yet to be determined, at the September 27, 2010 hearing, at the usual opening time, with an invitation to file an appearance at least twenty days before the hearing and to appear at the specified hearing, subject to the warning that filing an appearance after this period will mean the disqualification of Articles 38 and 167 of the Code of Civil Procedure, and that if she does not appear, the hearing will proceed in absentia, in order to consider the following

Conclusions

May it please the Honorable Judge, dismissing any claim to the contrary, to grant our petition to:

as a preliminary and precautionary measure: ascertain and declare the continuation and the perpetration of harm to the integrity, honor, and dignity of the Church of Scientology and its parishioners as a direct result of offensive and disparaging statements made by Mrs. Di Gasparro Gardini and of the continued public availability of these statements (in the form of books or postings in newsgroups or interviews), and consequently establish a precautionary withdrawal from distribution of the published works containing the offensive phrases, as well as prescribe a prohibition on further publication and distribution, in any form and by any means, of the contents and references of these publications;

on the substance of the complaint: ascertain and declare the grave and persistent damage inflicted by the defendant upon the integrity, honor, and dignity of the Church of Scientology and its parishioners;

consequently: determine that Mrs. Di Gasparro Gardini is required to pay compensation for damage suffered by the Church of Scientology in Italy as the institution representing the Scientology religion on Italian territory and suffered by all profoundly injured parties, whose integrity has been damaged and who are offended by the words and statements made by Mrs. Di Gasparro Gardini, as described above;

order the defendant to pay an indemnity for the damage suffered by the Church of Scientology of Italy to its integrity and honor as a result of the derogatory and defamatory actions perpetrated by Mrs. Di Gasparro Gardini and compensate this damage, quantifiable as a lump sum of 1,000,000 (one million) euros plus interest, or an amount determined to be equitable;

order the defendant, in addition, to pay an indemnity for the moral damage suffered by the Church of Scientology of Italy, in terms of moral hardship and suffering inflicted upon the parishioners and ministers of the Italian Church of Scientology and compensate this damage, quantifiable as a lump sum of 1,000,000 (one million) euros, or an amount determined to be equitable.

The term "Fair game" was cancelled in 1968, more than 25 years ago, because it was susceptible to interpretation and identification by the victims of scientology as "fair game". The practice of fair game was never cancelled, only use of the term "fair game".

On January 21, 2008, Italian police rescued Frenchwoman Martine Boublil from a house where she was being held by three Scientologists. Ms Boublil was allegedly kidnapped in France on the instructions of her brother, a senior Scientologist and doctor, and transported to Sardinia, where she was kept for 6 weeks in appalling sanitary conditions. Police rescuers found her semi-nude on a bug-infested mattress. The woman, who suffers from major depression, was apparently being held for an "Isolation Watch" or "Introspection Rundown". After her rescue, she spent several weeks in an Italian psychiatric hospital before being repatriated.

Four scientologists have been charged with false imprisonment.

Can we see a link here with the affair of his sister in Sardinia? "There can be no doubt", insists Arnaud Palisson, former officer of the general Information and specialist in Scientology. For him, the "hell" described by Martine Boublil is not just a simple matter. "They did not address a word to me. To say yes, they blinked eyes, for not, they left them open ", the victim told "Parisien" before her return in France. According to Palisson, this
silence corresponds exactly to a classic scientology procedure reserved for "psychotics", and called "Isolation Watch" by Hubbard. Several internal memos describe the precise protocol to be followed:"In the presence of a person undergoing a psychotic crisis, totally isolate this person, all communications made must be silent.”

The Falsehoods of the Scientology Press Release About the Lawsuit for Damages Against Maria Pia Gardini

The Scientology press release is in bold black type, my response is in red.

The National Church of Scientology of Italy has brought proceedings against Mrs. Maria Pia Di Gasparro Gardini for damages totaling two million euros.

Scientology forgot to state that this is what they are asking for and that they are the ones who came up with this amount, certainly not a judge, since the legal proceeding is still in the early stage.

Mrs. Di Gasparro Gardini has for years disseminated false information about the doctrine and rites of Scientology and about the procedures and activities of the Church of Scientology and its collaborators.

A totally false and biased statement for which Scientology will soon have to answer legally. Moreover, Scientology has for years pursued a violent hate and smear campaign against Mrs. Maria Pia Gardini and deliberately says nothing about the 963 persons who have publicly criticized this "cult," whose sole aim is to sell "packages" for acquiring "knowledge." Scientology is essentially an "over-the-counter religion". It's a retail sales operation.

To prove what I'm saying, here is the 2009 price list for "auditing" services at Flag and, of course, the price list for the "stay" at Flag.






The verbal violence, the unjustified insults, the demonstrated acrimony and the false allegations by Mrs. Di Gasparro Gardini have led the National Church of Scientology of Italy to protect the honor, dignity, and reputation of the Church and of the parishioners of the Scientology religion.

I can testify and I have proof, of course, that one Scientologist has several times, in various posts which are preserved on the server of this magazine, invited me to "go take it in the ass" and I can also testify that the followers of the sect have repeatedly insulted me, most recently referring to me as a "Nazi fascist." Talk about "verbal violence and unjustified insults."

The statements and the stories of Mrs. Di Gasparro Gardini can be better understood if one takes into account the fact that she is an apostate.

The statements of the "Church" of Scientology can be better understood if one takes into account the fact that it wants to maintain its economic power and its own wealth.

As Prof. Bryan Wilson, one the most knowledgeable sociologists concerning the phenomenon of new religions, wrote: "The disaffected and the apostate are in particular informants whose evidence has to be used with circumspection. The apostate is generally in need of self-justification. He seeks to reconstruct his own past, to excuse his former affiliations, and to blame those who were formerly his closest associates. Not uncommonly the apostate learns to rehearse an ‘atrocity story’ to explain how, by manipulation, trickery, coercion, or deceit, he was induced to join or to remain within an organization that he now forswears and condemns. Apostates, sensationalized by the press, have sometimes sought to make a profit from accounts of their experiences in stories sold to newspapers or produced as books (sometimes written by ‘ghost’ writers). [Bryan Wilson, The Social Dimensions of Sectarianism, Oxford: Clarendon Press, 1990, p.19.]

Scientology forgets to write that Bryan Wilson was a "friend" of the Scientology psycho-sect and that Wilson even expressed favor about another "friend" of the psycho-sect, Massimo Introvigne.
"[...] In a eulogical article by Massimo Introvigne, Director of the Center for Studies on New Religions (CESNUR), he is described as 'one of the most distinguished sociologists of the 20th century' who has exercised 'a crucial influence on the sociology of religion, not only through his many publications but also through the generations of his graduate students.[...]' [wikipedia]
Wilson, in turn, was prepared not to know that Introvigne is not actually a sociologist. If these are reliable sources ...

The rest of the press release is obviously sheer callous propaganda. The mafia too has various groups and associations in the world and tries to "worm its way" into countries. What Scientology deliberately does not say in the press release is that there are dozens of ongoing cases against it and that its leader Miscavige is named as a defendant in a trial for "slavery and child labor." So "dearest" - in the sense of "most costly" - Scientology, when one puts out a press release, it would be a good idea not to "talk trash."


By her own admission, Mrs. Di Gasparro Gardini was not reliable when she was a member of the Church of Scientology, and she is not reliable even now.

The worldwide growth of Scientology refutes her assertions. Between 2004 and today, the Church of Scientology has doubled in size and acquired 70 buildings in major cities of the world. 15 new Churches of Scientology have been inaugurated and opened since 2003 in Madrid, New York, London, Rome, Washington, Brussels, Quebec City, Las Vegas, and other cities. In addition, 57 other new buildings were acquired for Churches that are nearing completion.

On October 24, 2009, before 6,000 Scientologists, the new headquarters of the Church of Scientology of Rome were inaugurated. The 7,000-square-meter building, surrounded by a 40,000-square-meter green area in the Casalotti district, has become the reference point for parishioners in Lazio and in the South Mediterranean area.

The Church of Scientology now has 8,000 churches, missions, and groups in 165 countries around the world. Its members are persons of every age, race, social class, and occupation. Many of them are engaged in social activities such as the largest non-governmental campaign to prevent drug use and the widest global campaign to raise awareness about the application of the rights enshrined in the Universal Declaration of Human Rights.

Others, as in Italy, have formed a civil protection group and intervene whenever there is a natural disaster, as was proven during the earthquake in Abruzzo and, recently, in Haiti.

Persons who wish to obtain more information may consult the works of L. Ron Hubbard, which are available in many public libraries in Italy, or visit the www.scientology.it website


Given the unclear behavior and the incessant false press releases disseminated by Scientology, I continue, with strength and resolution, to repeat my appeal:

For this reason, I formally, from the pages of this magazine, request:

  • that the competent authorities verify the actual funds and property of Scientology on Italian territory
  • that the Ministry of Health perform a verification concerning the "Narconon" communities which charge money for a detoxification method with no scientific value
  • that consumer groups campaign against this psycho-sect which operates on Italian territory and practices mental conditioning
  • that antitrust authorities take action against the "deceptive advertising" and "press releases" that Scientology spreads over the Internet
In conclusion, I appeal to all honest parliamentarians who know the dangers of psycho-sects to launch an inquiry into the real activity of Scientology in Italy.

The problem of psycho-sects touches 1 million people in Italy. It is a very grave problem which must be tackled seriously and firmly.
