BACKGROUND:

California Senate Bill 276 would attempt to combat alleged fake medical exemptions to California's mandatory vaccination law. Specifically, the bill would require the State Department of Public Health to develop and make available for use by licensed physicians and surgeons a statewide standardized medical exemption request form, which would be the only medical exemption documentation that a governing authority may accept. The bill would require the State Public Health Officer or the public health officer’s designee to approve or deny a medical exemption request, upon determining that the request provides sufficient medical evidence that the immunization is contraindicated by guidelines of the federal Centers of Disease Control and Prevention (CDC). The bill would specify the information to be included in the medical exemption form. The bill would require a physician and surgeon to inform a parent or guardian of the bill’s requirements and to examine the child and submit a completed medical exemption request form to the department, as specified. The bill would require the State Public Health Officer or designee to review the completed exemption request form and notify the physician and surgeon of the approval or denial of the request. The bill would require the reason for denial of a request to be included in the notification, and would authorize the physician and surgeon to submit additional information to the department for further review, as specified.

California Assembly Bill 262 would require a local health officer, during an outbreak of a communicable disease, or upon the imminent and proximate threat of a communicable disease outbreak or epidemic that threatens the public’s health, to notify and update governmental entities within the health officer’s jurisdiction about certain communicable diseases that may affect them, and make any relevant information available to those entities. The bill would authorize the local health officer to issue orders to other governmental entities within the local health officer’s jurisdiction to take any action the local health officer deems necessary to control the spread of the communicable disease.

California Senate Bill 421 would establish the Children’s Cabinet of California to consist of the Superintendent of Public Instruction, the Secretary of California Health and Human Services, and the head of each agency and department within the state that provides services for, or has jurisdiction over the well-being of, children, and would set forth its powers and duties, including promoting and implementing information sharing, collaboration, increased efficiency, and improved service delivery among and within the state’s child-serving agencies, departments, and organizations.

California Senate Bill 175 would would create the Minimum Essential Coverage Individual Mandate to generally require a California resident to ensure that the resident, and any dependent of the resident, is covered under minimum essential coverage, as defined, for each month beginning on January 1, 2020, except as specified.
