DM seems to be between a rock and a hard place, in a "no win" situation. If he lets the hearing go forward we could hear some testimony from Mosey that is very toxic to the cult. But if DM defaults to prevent that the judge will award damages, and being that Marty is married to Mosey than in effect DM would be paying money to Marty.

Judge to rule on whether Narconon Arrowhead must produce employee related documents in the negligence case of Heather Landmeier case out of OK. Of course, the cult is fighting it.

Most important matter because Plaintiff claims that staff gave Heather Landmeier drugs when she was in the program and she is now in a vegetable state after they dumped her at a motel during an overdose. Records requested include those of staff relapses and such. Article gives history of problems there including deaths and many other lawsuits ongoing for Negligence, Fraud and Wrongful Death

Quick question - I just read the article and am unclear: the hearing's set for Wednesday @ 10:00 AND the Judge really expected to rule on that day, too? Is the hearing not truly a traditional hearing (with arguments presented) -- rather, it's just the format opted-for by the Judge to opine on the record from the bench?

The plaintiffs have been trying to get these records for some time. Through discovery process, these specific records have not been turned over, hence the motion to compel them to produce them.

The judge will rule on this motion on the 18th. That is what the hearing is about. Whether to approve the motion to compel production of the documents or not. If approved by the judge, if ruled in favor of plaintiff's motion, Narconon will be given so many days to produce the documents or be held in contempt of court, with sanctions.

As the article states:

A judge is set to rule this week if Narconon Arrowhead will have to produce documents related to incidents of drug and alcohol use by its staff, according to court documents.

So...

On October 17, the Judge ruled that the discovery phase in this case is stopped until the 3rd mediation is finished? And whatever happens at the 3rd mediation attempt will be reported/discussed at the Dec 20 case mgmt conference?

Is this correct?
