Mark your calendars, folks; lots of important dates in September & October 2013 for court cases within the US related to Scientology/Co$ & Narconon. (Bolded dates for calendar; red date for general irony/lulz.)

September 5 -- Florida judge will consider the scope of subpoenas previously issued in the Florida-based Garcia Fraud lawsuit.
September 9 -- Las Vegas preliminary hearing for Devon Campbell Newman -- multiple criminal charges.
September 18 -- Oklahoma judge to hear motion to compel production of documents in the Landmeier v. Narconon suit. (Documents sought relate to the incidents of drug/alcohol use by residents/employees. Note: this suit was filed in March 2010 and it's still in the pre-trial phase.)
September 12 & 13 -- Texas hearing dates for Monique Rathbun's case re: temporary injunction issue.
September 30 -- The US Supreme Court conference to grant/deny certification to Co$/scientology's petition re: "priest-penitent confidentiality".
September 30 -- Georgia judge to hear appeal the license revocation of Narconon Georgia. (pp'd 2x already!)
October 3 -- Brian Culkin expected to testify as part of an evidentiary hearing in the Florida-based Garcia Fraud lawsuit.
October 6 -- 'Super Power' building opening in Clearwater, Florida.

In the class action suit filed in Georgia against Narconon & related entities, 2 rulings are expected in the near future: will ALL of the originally-named defendants remain as such; and, will the evidence gathered by Georgia state investigators be preserved...and be made available for use in current/future civil Narconon-related cases.

Per Wickstrom's lawsuit against a town's refusal to grant permission for him to expand his 'drug rehab facility', filed in Michigan state court but currently removed to federal jurisdiction, should also produce a few rulings shortly. A dismissal of the suit by a federal magistrate/judge would not be a surprise.

Will September 2013 be the month we finally see evidence of ANY action undertaken by the Oklahoma investigating authorities related to the Narconon facility there and the 3 people who died?

From Weekend Narconon News Roundup #4:

Narconon of Georgia has appealed the December 2012 license revocation, and that appeal is in progress.

They are allowed to continue operating during the appeal process, but according to insider information, there are few to no clients currently in the program. The formal hearing was scheduled for July 17, 2013, but was continued until August 26 and 27, 2013, prompting speculation that Narconon of Georgia was intending to put up a fight. Now the appeal hearing has been rescheduled for September 30, 2013. We hope there’s no funny business going on this time, but knowing how Narconon and Scientology operate, we’re pretty sure they’re trying.

The gruesome case, Teague v. Narconon Freedom Center and A Forever Recovery, in which a man (Teague) suffering from withdrawals set himself on fire, is in the process of taking depositions and is scheduled for trial in January 2014.

Re: Chicago case -- Here's the link to the Cook County Clerk of the Circuit Court page with a summary of the docketed events in this matter: https://w3.courtlink.lexisnexis.com/cookcounty/Finddock.asp?DocketKey=CABD0MB0EABFFH0MD On The Underground Bunker site, it says there's a hearing on October 19th, but the docket states the next appearance is on October 9th.

^^^^ After reviewing Mr. Rathbun's affidavit, along with the Amended Complaint, (which added 2 more Defendants - yay!) I think the Texas hearing currently scheduled for September 12 & 13 is likely to have additional time afforded -- not because I think the Judge doesn't have enough information to Order a temporary injunction.

Rather, it's more likely Miscavige/Co$/RTC/scientology/etc. will request additional time to argue their points/issues given the enormous amount of detail contained in Mr. Rathbun's affidavit.

Does anyone know if these Defendants: (1) are permitted to file additional affidavit(s)/information before September 12; and, (2) if so, what's the filing deadline?

Reminder: Today, the Florida Judge in the Garcia fraud case will consider the scope of subpoenas previously issued. Perhaps a ruling, too?

I say that DM does anything and everything he can (if he can) to make this case go away fast. Just as he did with the Debbie Cook case.

You're correct that DM won't want to argue what's now been raised in Mr. Rathbun's affidavit [minefields!] -- but I think additional affidavits/declarations will be filed before (and during) the hearing, in an attempt to refute (on paper alone) all/much that Mr. Rathbun's filing avers. DM & Co's Legal Team won't 'need' the paper refutations for the current Court as much as they'll need them to appeal the issue of whether or not the State of Texas has personal jurisdiction over DM. <----That's the issue that I think the defense attorneys will focus on for the next few years if the case doesn't settle soon.

I think yours is a sensible position to take - that DM will try everything to end this suit quickly; it's also the most reasonable position to take, given the circumstances. DM, on the other hand, appears neither sensible nor reasonable, given what is available to read/view about him in the public domain. Too, it's not unreasonable to think that his apparent animus towards Mr. Rathbun alone has warped whatever 'good' judgment he might have ever had.

Defending in this case, along with having to attend to the ever-growing number of other lawsuits in the US alone, would likely cause an ordinary person to buckle under the strain -- and, I think, the mistakes DM makes in this case will be visible, too, in the other litigated matters.

Mrs. Rathbun's brief appearance on the British tv documentary showed her to be warm, engaging, truthful, and altogether composed. Imagining her testifying from the witness stand must cause nightmares for DM & Co's Legal Team. For DM, I suspect he fears the image of himself sitting at a defense table. 'Defendant Miscavige' whether spoken aloud or in writing likely frightens him. It should.

Yeah, you're correct in this and DM's response is unpredictable to an extent because of this. Anyways, between this and the other cases it's time to stock up on popcorn! :biggrin:

On September 5, 2013, a Florida Judge was supposed to have considered the scope of previously-issued subpoenas in the Garcia fraud case. Does anyone know if the Judge issued a ruling about this issue? Have a link to dox/info to share?

She could've been talking about leaving Scientology, which she ditched in July in a highly publicized exit - Leah told People Magazine that she's 'not about to shut up' about the church's transgressions.

One final tidbit: we learned last night that a subpoena had been served on a representative for Scientology leader David Miscavige, requiring him to appear at Thursday’s temporary injunction hearing in Monique Rathbun’s lawsuit which is being held in New Braunfels, Texas.
As for Miscavige actually showing up, we were told: “don’t hold your breath.”

THE LAURA DECRESCENZO FORCED-ABORTION LAWSUIT: September 30 is the big day when the U.S. Supreme Court will sift through more than 850 petitions in a conference and select only a small percentage to move on to the next level. Scientology is hoping that its petition for a writ of certiorari is among those chosen. The church wants SCOTUS to rule that California’s “priest-penitent” law is unconstitutional so it can prevent Laura DeCrescenzo from making use of some 18,000 pages of evidence the church was forced to turn over.
