It is going to be interesting to see how the church proceeds in this case to demonstrate its well earned reputation the the example par excellence of "vexatious litigation" . . . with any luck
they might just get so outrageous in this case, now that Misavage has his arse in the sling, that they will earn some very major and serious censure from the Court such that it impacts all of their future malicious access to misuse of the Courts.
I do believe they are just about one stupid dead or false testimony away from that censure at the moment . . .

Unfortunately the "vexatious litigant" designation is made court-by-court. If Texas brands them such, they can shift to California or the Federal courts where they have not been so branded. The system is designed to allow even idiots access to redress legitimate grievances via the court, innocent until proven guilty in the new jurisdiction and all that, but it makes multi-state entities such as Co$ much harder to hobble when they use the courts to harrass.

Not being American I wonder if it would be possible to pass a federal law to establish a national vexatious litigant database? Presumably states could not be compelled to respect it though....?

There is a fundamental constitutional right to seek redress in the courts. As the Federal system is set up, there would be no use to a database - a judge looking at it would have seen prejudicial document and have to recuse him / herself, and each jurisdiction has to decide that status for itself.
The courts take the idea of depriving a citizen of that right very seriously, and hold a the definition of vexatious to a strict standard.
I am familiar with one case where a litigant is seriously vexatious, even to the point of beling labeled so in one jursidiction, but was able to have that reversed on appeal. He has filed in multiple jurisdictions (and maintains residences in at least 4 states that I am aware of) so that he is able to evade the system that way.
I'm not sure Congress could write a law that would force the courts to consider this kind of behavior without violating the Constitution. Even if they could, the overwhelming majority of lawmakers are lawyers, and have no interest in inhibiting their ability to make a buck. Solving this would likely require a Constitutional ammendment.

The issue of the Cof$ being a vexatious litigant was brought before the Court in Texas the last time by they were in Court there . . . I forget the defendants name for the moment, but it was the former CO of the FSO who wrote that delicious New Year's email . . . .
and we know how successful the Cof$ was in their suit against on that occasion.
