It has provoked some thoughts so here they are:
Internal justice is a dangerous slippery slope for a group to take. There has to be, to some extent, external checks and balances for any group to remain healthy. Scientology fights any and all possible external "interference" in many many ways.
The justice system of scientology is, of course, based on the grandiose concepts of Hubbard. He claimed to have the answers to everything and the external world was just full of dumb, ineffective, abberated, morons that could only improve their status/worthiness by participating in his scientology. In one or two easy moves, this places the group above domestic laws. No citizen, no group, is above the law. Every man, woman and child, in theory, is equally positioned before the law (yes we all realise this is often pure ideology but it is a decent concept nonetheless, imo). It isn’t really more complicated than that in most western nations. One law for all, though the access to certain due process varies depending on various factors such as financial limitations.
The scientology system walls the individual off from accessing external legal processes, claiming to have “superior justice tech” (this actually extends further to such things as employment arbitration tribunals and so forth). This is dangerously arrogant at best, and at worst it actually moves towards becoming - and enabling - criminal behaviour. The scientology system is also constantly in violation of international human rights codes. One day I plan to write about this using my own experience(s). The fact that scientology deals with criminal issues internally (Monique admits this in that clip), is serious stuff. We see time and time again, accounts of scientology opting individuals out of domestic law(s) in the many accounts of rapes being “handled” internally and various other abuses. It is very dubious to prevent a citizen accessing the full range of legal process available to every citizen of a nation. I am no lawyer but I do know a couple of things about this stuff from having to deal with the cult legally threatening me and discussions I had with lawyers at that time. Plus I was involved in legal stuff when I was a CCHR staff member so got the opportunity to talk to legally trained people and explore some legal concepts.
This was one of the definitive motivations for my leaving scientology. It became blatantly obvious to me that my legal rights as a NZ citizen had been seriously eroded by my participation in the cult. My access to tribunal arbitration, to freedom of speech, etc, had all been eroded and/or dissolved. I am first and foremost a citizen of New Zealand. No one and nothing can erode or tamper with it. I am here on equal terms with every other citizen. Scientology attempted to contract me out of that (via staff contracts, etc). No can do. The cult challenged me on this and I challenged them to explore this issue in court. The cult went silent. No one can contract me out of my rights as a citizen of my nation (there are exceptions but they are complicated and irrelevant in this instance). Religious status, charity status, etc, does not contract a citizen out of their obligations to uphold the laws of their nation or to freely participate in accessing the full range of legal remedies offered under domestic statute.
The systemically installed phobias used by scientology i.e. "you will lose your freedom, your eternity if you don’t tow the line” is a powerful control mechanism. It sure as hell held me tight for far too many years. It is more effective than barbed-wire fences in many ways. A mental prison is cheaper to build and requires little to no maintenance and best of all, it is invisible to external influences - those that could potentially monitor any violations of the laws pertaining to personal liberty (ref: magna carta). The mentally imprisoned person does all the work, self-monitors because of the intense fear installed about losing their “eternal freedom”. More abhorrent than even that, the cult member pays (with time, money, devotion, etc) to remain mentally imprisoned.
I (privately) predicted a few years ago that scientology will ultimately destroy itself because of its “us and them” system. This issue of walling citizens off from full access to domestic law(s) is non-sustainable. We are witnessing this more and more with ex's speaking out about the crimes they have seen being dealt with, badly, within scientology. Any group must interact in a healthy transparent way with the external world if it is to go the long haul. Scientology does not. Scientology cannot make old bones.
