Narconon: local cases

The Desmond case, NN Georgia, at Norcross, has produced a delicious argument pinning down the link between NN and NN International. NN operates the treatment centres while NN Int lurks in the background and denies liability. Well, it would, wouldn't it? But...

Narconon International, based in Los Angeles, is also named in the suit. Attorneys for the drug treatment organization with ties to the Church of Scientology said during Thursday’s hearing they were not responsible for the Norcross clinic’s alleged negligence.

“These two companies are separate corporations,” Narconon International lawyer David Root said. “International does not own, and Georgia is not a subsidiary, or local licensee.”

The international group is “not involved” in the Georgia group’s daily operations, Root said.

But the lawyer for Desmond’s parents, pointing to a contract between the two entities in which Narconon International agrees to provide periodic, on-site health and safety inspections, said its responsibility is irrefutable.

Of course it's not a court judgment, just a legal argument, but it seems a very reasonable argument to me and I hope it prevails.

Reaching for the Tipping Point has an extensive thread on this case. Documents galore. All NN Int execs lied under oath, NN Int has been blatantly refusing to give up documents related to the case and they are just generally taking no responsibility for their crimes. Phil Hart pushes these business agreements on the centers so they have the authority to come in and do inspections and makes changes, basically run the joint from Cali, but when their negligence causes a death, they play dumb and the separate corp card. NOPE!!! Jeff Harris and his crew are doing a great job of exposing the connection, which goes all the way to OSA and the Church. These connections are not isolated to NN GA either. You see them in all of the NN's.

There is lots of information about this case. eg.

DEKALB COUNTY, Ga. —

The family of a man who died while under the care of a local drug treatment facility won a huge court victory this week.

DeKalb County State Court Judge Stacey Hydrick issued sanctions against Narconon of Georgia, finding the program's director lied under oath and hid evidence.

"There's really nothing else that a judge can do that's stronger than what the judge has done here," said attorney Jeff Harris.

Harris is representing the family of Patrick Desmond, who died in 2008 after trying heroin for the first time.

Four Narconon treatment facilities in the US and Canada have been closed down recently: NN Stone Hawk, NN Newport Beach, NN Joshua Hills aka NN Desert Rehab, and NN Trois-Rivieres (closed April 2012).

Just a name change, maybe, but Narconon is on the run... or has at least begun to feel pressure.

From Oklahoma a move in the right direction.

After several deaths at Narconon Arrowhead, a senator has proposed legislation to regulate private drug and alcohol facilities.

In August Sen. Tom Ivester (D-OK 26th District) told the News- Capital he would work with officials at Oklahoma’s Department of Mental Health and Substance Abuse Services to author legislation aimed at “regulating questionable practices” at Narconon Arrowhead.

Sorry, but nope.

Retraction of tax exempt status was only for Nabesa.
For clarity: anbi-status [tax exemption] still exists for Narconon and De weg naar het geluk = The way to happiness.

No changes there. See for yourself: go to http://www.belastingdienst.nl/rekenhulpen/giften/anbi_zoeken/

and type Narconon in the "Instelling" field, then hit "Zoek" [search] . Same for "Weg naar het geluk".

OP definitely has reached a nice win though.
I just checked and narconon still has tax exemption.

My bad. It was Scientology's 'social benefit' organisation NABESA that lost its charitable status. As TrevAnon has pointed out more than once!

The heading is wrong.

But complaints about Narconon were made in 2012.

So let's hope Narconon is next.
