Another night to sleep on things and despite my own feelings that it will all be ok, I've decided to engage a lawyer.

I have to run off to work now and can't be doing to much of this on company time but I'd really appreciate if you guys could do some research for me today and see if you can find me a lawyer who specialises in this kind of defence.

The (pending) charges are concerned with "Unauthorised Impairment of electronic communication". And "Consipracy and incitement to cause Unauthorised Impairment of Electronic Communications".

If you could do some research on cases in Melbourne defended successfully and get me a few lawyers names that would be very helpful.

I also had a thought today, the Electronic Freedom Foundation might be interested in this. They have featured Scientology's attempts to squash critics and whistleblowers in the past in the US.

Who knows - it might turn up something.

I will contact them and let you know what I find out.

Ems, I’m very glad to hear that you’ve decide to get legal representation. It would be nice to think that all one had to do was be totally honest and open and tell the police everything and they would say “Well, now that you’ve explained it all we can see that there is nothing to this and we are dropping all charges!”, but unfortunately life isn’t like that.

You can bet your bottom dollar that the cult will be employing lawyers and possibly PIs to try and dig up stuff (anything!) that they might be able to use against you. This includes your PC folders and Ethics and staff folders. They will also probably be pressuring the police behind the scenes. Alert your neighbours that strangers might come sniffing around.

It is imperative that you get legal representation if for no other reason than to be made aware of your rights and so that you don’t get bullied into doing anything against your best interests.

Also, it would be a good idea if you gave the police a list, with supporting evidence, of all the cases where the cult have used the law / police to harass those that dare to stand up to them. Perhaps we could start a thread for future reference?

This should be a lesson to us all. Be on your guard! No matter how reasonable or decent you think the cult may be, they will stop at nothing to silence their opponents. This isn’t the first time they have manipulated evidence to try and incriminate the innocent and it won’t be the last. Also, be aware that having the police raid your home to seize computers is a favourite tactic and has been used on others recently. So take precautions and have backups.

I am very sorry that this happened to you, but I suppose it isn’t that unexpected. This is how the cult tries to silence its critics - by intimidation and skulduggery. They have no respect for the law and will manipulate it as much as they can to achieve their despicable aims.

Please know that you have our support and don’t be too proud to ask for help.

Yah. They are NOT decent. I don't think there's anything they wouldn't do if they thought they were "hurt(ing) another in a just cause". Lawyering up is the best way to go.

Taking down the "Religious Freedom Watch" web site? Meh.

Making it impossible for people to access the web site for their bank, stock broker, airline, etc, etc can result in losses of tens of millions of dollars. It's this latter category that I think legislators were thinking of when they proposed harsh penalties.

I agree, storm in a tea cup, cults bawing like when $10,000 ($25) worth of pansies got tromped at Hemet.

Just to clarify - I'm engaging a lawyer not just in case I need the defence, but to make sure the police don't let the CoS anywhere near my equipment. Also to check whether the warrant should have been issued in the first place based on what they call "evidence" and to see if I have any path of recourse.

If I can prove to the police (which I think is very likely) that there should never have been a warrant signed off by the magistrate, I intend to take action against any and all parties involved and get compensation for the loss of equipment, time off work, stress & duress and any other costs involved.

Of course the real tragedy here is that Tansy has lost his entire collection of Johnny Mathis and ABBA albums. I kept telling him to have backups, but he kept just quoting articles on how reliable modern disk drives were, blah blah blah…

Oh well, since he gave me his collection of CDs before he left the UK, I guess I’ll just have to Fed-Ex them over to Oz (at my expense naturally). :eyeroll:

Yes indeedy.

Even though it is 100% standard Scientology tech by L Ron Hubbard to find or manufacture evidence against its critics, it is also 100% criminal activity to manufacture false or deceptive evidence to try to frame a person.

Scientology has deep pockets. That makes them a desirable target for the right lawyer who can read the tea leaves on the wall there in Australia.

This might be quite an opportunity.

I just read this thread, then I read Dillatante's last post where he/she was celebrating the freedom and scariness of being allowed to think their own thoughts, say things and be critical, honest, open and emotional because of ESMB. It reminded me of why this board and every effort we make, every discomfit we endure is so important.

Thank you Emma, again, for all that you have done and endured to provide this safe space for us. You don't have to endure this alone, whatever you need, you ask for it.

Thank you to the moderators who have wokred over the years of ESMB supporting Emma and the rest of us in keeping the board working, and to all those who have put up money to keep it going.

Thank you to all of us who have posted and are posting and encouraging people out of the trap, bring up the issues, challenging the old chains of hubbard's ideas and the Church's abuse so that we can emerge into the real world and retake our soverignty of thought and emotion. And to thse who provide enough fluff anf fun so we can also play and enjoy friendships and silliness and cute kitties.

The Church is crashing, the end is in sight and they are desparate.

We are stronger than ever, individually, as a group and as those who say "No more lies, the truth is coming out."

Legally, ethically, with care for those who need to escape we bring sunlight to the rotten practices and history of this corrupt religious group. We are relentless.

We enable people to ask the real questions, in as much annonymity as they feel they need, of others, and of themselves without pre-written answers or hidden agendas of making money or self agrandizement. In a forum where they can be sure to be listened to and answered honestly, without judgement or condemnation or personal attack, that costs them nothing.

We empower people to make their own choices and respect them when made (if not in our hearts, at least in our words).

We are not in it for power or money, for the opportunity to demean others or make ourselves feel superior.

We are the opposite of the Church of Scientology.

We may well be exceptionally fine examples of a great many of the values they say they embody but which they betray everyday. Truth, respect, openness, sincerity, action, freedom, real communication, healthy dynamic balance, a team... It may be one reason they are so frightened of us, and with good reason. Evil cannot continue when good men and women do the right thing. The Church just wont survive when the governments recognise the Church's lies, illegal activities, and destructive effect on the community. When it is demanded the COS follow the laws designed to protect individuals they will be unable to comply. Now that we are standing up for the rights of those still inside the COS these people begin to see the abuse they have endured for what it is. We all have, that OT VIII did, and so are people inside every day, every hour. The last straw, for each individual and for the group will be when the fundamental lies :"You are flawed" "We know better than you" and "We have a way for you to be perfect/importal gods" are just too clear to be ignored.

Emma, whatever you need, when you need it. You know it is here.

Those coming out of the trap, we are here for you and are going to be here for you until Scientology is just a story that people use as a cautionary tale.
